1. These Rules on event visitors for events promoted by Park Live World TM and ticket refund policy (hereinafter referred to as the Rules) establish the rules for event visitors, i.e. spectators who have purchased tickets for pop concerts and other mass cultural events (hereinafter the concert, concerts) promoted by Park Live World TM (hereinafter the Concert Promoter), during their visit, as well as the procedure for changing and refunding tickets purchased for these events.
By purchasing tickets, visitors agree to be bound by these Rules. In turn, in case of changing or refunding tickets, the Concert Promoter shall apply these Rules without regard to the date when tickets are purchased.
The Concert Promoter and visitors shall, by mutual agreement executed in writing, have the right to depart from these Rules and agree on a different procedure for changing and refunding tickets purchased for the concert, if this does not worsen their position as compared to the regulation established by these Rules.
Without reference to any instructions herein, the provisions concerning visitors shall also apply to any other visitors attending the venue at the time of the concert.
2. These Rules have been developed in accordance with the civil laws and the consumer protection laws of the country where the concerts are held.
3. Any competitions and conflicts between different legal acts to be applied instead of the provisions of these Rules, including due to the absence of relevant requirements herein, shall be resolved in accordance with the laws on regulatory legal acts and administrative procedures, as well as other applicable rules.
In case of contradictions between similar regulatory provisions of these Rules and similar rules of ticket operators or concert venue owners, the Concert Promoter shall apply these Rules, unless otherwise established by the relevant agreements between the Concert Promoter and the counter party.
4. Attendance at any concert shall only be allowed for visitors subject to compliance with these Rules, as well as the legal acts listed in sub-clauses 2 and 3.
Regardless of the provisions of paragraph 1 of this clause, visitors shall respect the following bans on:
*bringing and using professional photo- and video- equipment,
*bringing and using drones and other aircraft,
*using intellectual deliverables, including the trademarks of the Concert Promoter, creating works based on the sound and video recordings of the concert, without the express consent of the Concert Promoter.
Unless otherwise provided by these Rules, if age ratings are established for the concert in accordance with the laws of the country in which the concert is held, visitors shall have the right to attend the concert only if they have original passports or other documents that are recognised by the current laws and regulations as the documents certifying the identity of such visitors.
In addition to the requirement specified in paragraph 6 of this clause, and unless otherwise provided by these Rules, minor visitors, who have not reached the age specified in the information product mark, shall have the right to attend the concert only if accompanied by their parents or other legal representatives (guardians, trustees) if the latter have original passports or other documents that are recognised by the current laws and regulations as documents certifying the identity of such visitors, as well as documents confirming their kinship, guardianship or trusteeship.
Notwithstanding any requirements specified in paragraphs 6 and 7 of this clause, minor visitors shall not have the right to attend any 18+ concerts, including even if accompanied by their parents or other legal representatives (guardians, trustees).
The information product mark assigned by the Concert Promoter shall be placed on any posters and advertising materials of the relevant concert.
5. Failure to comply with the Rules and the legal acts listed in paragraphs 2 and 3 shall be deemed grounds for refusing entry to the concert and entail removal from the concert without refund.
Any removal from the concert shall be documented as a visitor removal report, drawn up in free form stating the date, time and place of their drawing, the concert name and signed by persons authorised by the Concert Promoter and the visitors (their representatives). If the visitors refuse to sign a removal report, a note should be made on the report itself to indicate the refusal.
Regardless of any violations of these Rules, the following persons shall not be allowed to attend and be removed from the concert without refund (subject to the drawing of a visitor removal report under procedure outlined in paragraph 2 of this clause):
*persons who do not have in their possession any documents stipulated in clause 4 hereof;
*persons who are under the influence of alcohol or other toxic or narcotic substances;
*persons whose aggressive behaviour endangers the safety of guests or staff;
*persons who are wearing dirty and stained clothing;
*persons who have animals with them;
*persons in possession of narcotic, toxic, poisonous substances, potent medications, alcoholic beverages (except those purchased at the concert venue), food products (except for baby foods for young children), bladed weapons, piercing and cutting objects, bludgeoning weapons (batons, nunchucks, brass knuckles, etc.), firearms and self-defence weapons (electric shockers, traumatic pistols, pepper-spray projectiles), as well as highly flammable liquids and explosive objects;
*persons who violate any other generally accepted moral and ethical rules.
6. Visitors shall be civilly liable for the loss of or damage to equipment, inventory, utensils, interior items, furniture, and decoration (intentionally and voluntarily) used by the Concert Promoter, and shall compensate for the damage caused by them based on the actual value of the damaged or lost property.
Any fact of loss of or damage to the property specified in paragraph 1 of this clause shall be documented in a property loss or damage report to be drawn up in free form stating the date, time and place of its drawing, the concert name, a complete list and value of each item of property with a mark on its loss or damage, and description of the type and amount of damage caused to each item.
A property loss or damage report shall be signed by any persons authorised by the Concert Promoter and the visitor (their representatives). If the visitor refuses to sign a property loss or damage report, a note should be made on the report itself to indicate the refusal.
If the visitor refuses to compensate for damage caused, its costs shall be recovered from the visitor through judicial procedures.
7. Visitors entering the concert venue may become part of any amateur or professional photo-, video- filming or audio recording and shall give their consent to the use of these materials for the internal needs of the Concert Promoter, video, television and radio broadcasts, publications in the press or on the Internet, and for recording the circumstances listed in sub-clauses 5 and 6 hereof.
8. Each visitor who has purchased a concert ticket gives their consent to the Concert Promoter to process their personal data transferred by visitors and required for drawing up reports listed in clauses 5 and 6 hereof, purchasing, changing and getting a refund for a ticket.
Such personal data includes data transferred by the visitors in accordance herewith.
The Concert Promoter shall process personal data in accordance with the personal data protection laws.
If a visitor refuses to provide their necessary personal data to the Concert Promoter, it may result in:
*failure to purchase, change or get a refund for a ticket;
*calling the police and handing a visitor over to law enforcement agencies in the event of a violation of these Rules, loss of, or damage to property (clause 6) to check the identity, prevent illegal activities, and document any offence committed by a visitor;
*refusal to consider any visitor's request, including a request for changing or getting a refund for concert tickets.
9. The decision on change or refund of tickets shall be made exclusively by the Concert Promoter after visitors have submitted applications using the website’s form
https://parklive.world/ on the Internet information and telecommunication network, subject to acceptance of applications for consideration.
Ticket operators and other agents shall have the right to change or refund tickets purchased for concerts of the Concert Promoter strictly subject to prior permission of the latter. If the application is sent to the agent, the latter shall not consider it and provide a visitor with the e-mail address to be used for communications between the Concert Promoter and the visitor on any issues related to the application hereof.
If several tickets have been purchased, the consumer shall submit a separate change or refund application for each ticket.
